Terms of Service

Last updated: September 20, 2026

These Terms of Service ("Terms") govern your use of the Forte Platforms compute hosting service ("Forte," "the Service," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.

1. Service Description

Forte is a compute platform that enables you to build, deploy, and manage containerized applications. The Service includes project management, automated builds from source code repositories, container hosting, deployment orchestration, and related tools.

2. Feature Maturity

Features identified as Closed Alpha are provided to a limited group on an "as is" and "as available" basis. For those features:

  • Features may change, be removed, or be added without prior notice.
  • We do not guarantee any specific uptime or availability targets.
  • The Service may experience interruptions for maintenance or updates.
  • Pricing and plan structures may change as the platform evolves.

3. Account Responsibilities

  • You must provide accurate information when creating your account.
  • You are responsible for maintaining the security of your account credentials, API keys, and session tokens.
  • You are responsible for all activity that occurs under your account.
  • You must notify us promptly if you suspect unauthorized access to your account.

4. Acceptable Use

You agree not to use, or facilitate or allow others to use, the Service to:

Illegal, harmful, and fraudulent activity

  • Violate any applicable law or regulation, or the rights of others.
  • Engage in fraudulent, deceptive, or phishing activity.
  • Threaten, incite, promote, or actively encourage violence, terrorism, or other serious harm.

Infringing and harmful content

  • Infringe or misappropriate any copyright, trademark, patent, trade secret, or other proprietary right.
  • Impersonate any person or entity, or forge or manipulate identifiers to misrepresent your identity or the origin of content or communications.
  • Publish content that is defamatory, harassing, or invasive of another person's privacy.
  • Promote hatred, harassment, or discrimination against individuals or groups.

Security and network abuse

  • Gain or attempt to gain unauthorized access to any system, network, account, or data, including your own resources beyond your authorization or those of any third party.
  • Conduct denial-of-service (DoS/DDoS) attacks, port scans, penetration tests, or vulnerability scans against any system without authorization.
  • Distribute malware, viruses, worms, or ransomware, or operate botnets, command-and-control infrastructure, or other malicious software.
  • Attempt to brute-force credentials or otherwise circumvent authentication or access controls.
  • Interfere with, degrade, or disrupt the Service or its use by other customers.

Messaging and email abuse

  • Send unsolicited bulk or commercial messages ("spam"), or facilitate the sending of such messages.
  • Operate open mail relays or open proxies, or configure a mail server to process third-party mail without authentication.
  • Forge or spoof email headers, or host content or sites advertised via spam sent from any network.
  • Fail to comply with the CAN-SPAM Act and other applicable anti-spam laws and regulations.

Prohibited workloads and resource abuse

  • Mine cryptocurrency without our prior written approval.
  • Run open proxies, anonymizing relays, or general traffic-relaying services.
  • Operate high-yield investment programs, pyramid or multi-level-marketing schemes, or similar activities where illegal.
  • Consume resources in a manner designed to evade fair-use limits or that disproportionately degrades shared infrastructure.
  • Use the Service in any way that causes Forte's IP addresses or infrastructure to be blocklisted, or that otherwise harms Forte or its customers.

Enforcement

We may investigate any suspected violation of this policy and may remove or disable access to any content or resource that violates it. When determining whether a violation has occurred, we may consider your ability and willingness to comply, including the controls you have in place to prevent, identify, and remove prohibited content or activity.

We may suspend or terminate accounts that violate these Terms—with or without prior notice depending on the severity of the violation—and you agree to cooperate with us to remedy any violation. We may cooperate with law enforcement where appropriate.

5. Your Content and Intellectual Property

You retain all ownership rights to the source code, applications, and data you deploy on Forte. We do not claim any intellectual property rights over your content. We access your content only as necessary to provide the Service, such as building and deploying your applications.

6. Forte's Intellectual Property and Use Restrictions

The Service—including its software, features, user interface, design, and documentation—is owned by Forte and protected by intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable right to access and use the Service for your own projects and business. Except as expressly permitted, you agree not to:

  • Copy, modify, or create derivative works of the Service or any part of it.
  • Reverse engineer, decompile, or disassemble the Service, except where this restriction is prohibited by law.
  • Access or use the Service in order to build a competing product or service, or to copy its features, functions, or user interface.
  • Resell, sublicense, or offer the Service to third parties as your own hosted or managed offering without our written agreement.
  • Remove or obscure any proprietary notices in the Service.

7. Service Availability

We strive to maintain the availability of the Service but do not guarantee uninterrupted access. We may temporarily suspend the Service for maintenance, updates, or other operational reasons. We will make reasonable efforts to provide advance notice of planned downtime.

8. Termination

You may close your account at any time. We may suspend or terminate your access to the Service if you violate these Terms, if required by law, or if we discontinue the Service. Upon termination, we will make reasonable efforts to allow you to retrieve your data for a limited period.

9. Limitation of Liability

To the maximum extent permitted by law, Forte and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the Service.

Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free or that defects will be corrected.

11. Changes to These Terms

We may update these Terms from time to time as the Service and its feature maturity change. We will notify you of material changes via email or through the platform. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.
